Penfield Addiction Ministries is committed to protecting the privacy and security of your health information. This Notice describes how we may use and disclose protected health information ("PHI") and the rights you have regarding your information.

Protected Health Information

PHI is individually identifiable information relating to your health, health care, treatment, or payment for health care. This may include your name, contact information, medical history, diagnoses, treatment information, medications, and other information related to your care.

Because Penfield provides substance use disorder services, certain treatment records may also receive additional federal confidentiality protections under 42 CFR Part 2.

How We May Use and Disclose Your Information

We may use or disclose PHI as permitted or required by law, including for:

Treatment: Providing, coordinating, or managing your health care and treatment.

Payment: Processing or obtaining payment for services.

Health Care Operations: Managing our programs, improving services, quality assurance, and other permitted operational activities.

Legal and Regulatory Requirements: Disclosures required or permitted by federal or state law, including certain public health, oversight, judicial, or law enforcement purposes.

Health and Safety: Preventing or reducing a serious and imminent threat to the health or safety of an individual or the public.

Certain uses and disclosures, including marketing and other activities specified by law, require your written authorization.

Substance Use Disorder Records

Penfield recognizes that substance use disorder treatment records are subject to heightened federal confidentiality protections.

Where 42 CFR Part 2 applies, Penfield will obtain the consent required by law before using or disclosing protected substance use disorder records, except when a disclosure is specifically permitted or required by law.

We will not use or disclose substance use disorder records in a manner prohibited by applicable federal or state law.

Your Privacy Rights

Subject to applicable legal limitations, you have the right to:

Inspect and obtain a copy of your PHI.

Request corrections to your PHI.

Request restrictions on certain uses and disclosures.

Request confidential communications by a particular method or at a particular location.

Request an accounting of certain disclosures.

Receive a copy of this Notice.

File a privacy complaint without fear of retaliation.

You may also revoke a written authorization for the use or disclosure of your information, except to the extent Penfield has already relied upon that authorization.

Our Responsibilities

Penfield is required to maintain the privacy and security of PHI, provide this Notice describing our privacy practices and legal obligations, follow the terms of the current Notice, and notify affected individuals of certain breaches of unsecured PHI when required by law.

We maintain reasonable administrative, physical, and technical safeguards designed to protect PHI from unauthorized access, use, disclosure, alteration, or destruction.

Changes to This Notice

Penfield may update this Notice from time to time. The current version will be posted on our website and made available upon request.
